Jesuit Haciendas Sequence

Various papeles judiciales pertenecientes a las Haciendas de Santa Lucía, San Javier y sus anexas. Tomo 1. 1550-1780; compiled 1783. 1080 l. (Indexed)

Indexed judicial papers pertaining to a legal dispute, 1564-1616, (Alonso González versus Juan de Valladolid and Francisco Bueno) over the size, boundaries, and validity of grants of a portion of the lands later incorporated into Hacienda Santa Lucía. The second part of the volume, also indexed, contains legal documents, dispatches, land donations, royal land grants, land titles, and testimonies pertaining to Hacienda Santa Lucía, nearby haciendas, and surrounding Indian villages.

As the records of the Gonzales lawsuit are extensive, the descriptions have been written tersely. Pagination is not given; most items are three to four pages in length.

356. Testimonio por el que consta que, en 28 de febrero de 1570, se presentó ante el Justicia de Texcoco Alonso González contra Juan de Valladolid y Francisco Bueno sobre la medida de un sitio de estancia, apelando de una sentencia en que se le había mandado demoler sus casas. Sigue una Real Provisión para la remisión de los citados autos a la Real Audiencia. 1616.

362. Los mismos naturales, en el acto de esta diligencia, dijeron poderse hacer la merced por estar sin perjuicio de su pueblo, con condición de que el ganado no entrase en el pueblo ni les hiciese daño. 1565.

371. En 5 de noviembre de 568 Alonso González presentó escrito ante el Justicia de Texcoco en que dijo tener y poseer un sitio de menor en términos de Xaltocan, donde se decía Siguastiquipaque, y que de pocos días Francisco Bueno y Juan de Valladolid habían querido fabricar casa dentro de la dicha estancia; así, era de derribar la casa y condenarlos a que la quitasen, y que, con citación, se midiese en conformidad de sus títulos y ordenanza, y, hallándose dentro de ella, se quitára la dicha casa, sacáran los ganados, y los contrarios mostrásen sus títulos. 1565.

contaron mil pasos de a cinco tercias, a cuyo fin se puso mojonera de palo y tierra. La otra medida comenzó de norte a sur, desde una esquina de la misma casa, y a los dos mil pasos, atravesada una calzada que va de Xaltocan a Tecamac, se puso una cruz.

Llevada la medida al poniente, con otros dos mil pasos, a su extremo se puso igual mojonera de palo y tierra. Hecha la del sur, se llegó a un río hondo, junto a la laguna (que no se pudo pasar), y hasta allí hubo cuatrocientos y cincuenta pasos, en cuyo lugar se señaló mojonera. Vueltos a la casa de González, se llevó la otra medida en derechera al jacal que había puesto Francisco Bueno, a orilla de la laguna, entre oriente y sur, y hubo ochocientos pasos y se señalo mojonera con una cruz adelante del jacal; notificóse a Bueno que ni él ni otro la quitásen y que dentro de seis días removiese el jacal; a lo que respondió que él era arrendatario de Andrés de Loza y que apelaba para la Real Audiencia. 1569.

386. A los 6 de mayo presentó escrito González ante el Justicia, quejandose de que Francisco Bueno y Juan Valladolid, aun cumplido el término impuesto para que dejasen libre la estancia, no lo habían hecho; concluyendo en que se les mandase salir. Se mandó exhibiese, y exhibió González, cuatro pesos para el asesor. 1569.

387. En este estado, Juan de Valladolid, en 26 de abril de 569, había presentado escrito y sus títulos contradiciendo la medida, por estar la antes hecha jurídicamente. 1569.

390. En 17 del mismo octubre pidió y se le dió posesión a Valladolid de la dicha merced, sin contradicción. (Pero no consta citación alguna). 1567.

Pero el mismo día presentó escrito Valladolid diciendo haber llegado a su noticia que se iban a medir los pasos que había de su estancia, pero que González, maliciosamente, habría ocho meses, tenía fabricada casa en tierras de Su Majestad, despoblando la que tenía en tierras compradas a Juan Bautista Figueroa, y concluyó en que, hecha medida de la distancia que había desde el sitio (de que le hizo merced el excelentísimo señor Marqués de Falces) a las casas en que vivía González, también se midiese la que había desde esta casa a la que había dejado con malicia. ojo de agua y hubo un mil y cincuenta pasos de a cinco tercias hasta la casa nuevamente puesta por González; de suerte que desde esta situación vieja al sitio de Valladolid había dos mil y doscientos pasos. De esta medida pidió testimonio González y se le mandó dar. 1567.

393. También Juan de Valladolid, en 10 de noviembre de 567, pidió ante el mismo Justicia de Chiconautla testimonio de la información que los principales y el Regidor de México dieron sobre que las tierras en que estaba el sitio de

Francisco Bueno eran de la estancia de San Pedro Atzumpa, y no del pueblo de Tecamac. Se le mandó dar. 1567.

394. Puesto el testimonio, de él consta que los Regidores de México, en 8 de noviembre de 567, presentaron en Chiconautla cinco indios, Gobernador y principales de Tecamac que, con efecto, uniformemente absuelven que las tierras de la estancia de Bueno eran de la de San Pedro Atzumpa y no de Tecamac. 1567.

395. Pidió asímismo Valladolid que González fuese examinado sobre haberse pasado media legua de distancia de la población, que antes tenía, acercandose a un río de agua dulce, y que se le hiciesen las demás preguntas y repreguntas que fuesen necesarias y lo mismo a los testigos que presentase. Así se mandó. 1567.

Examinado González, dijo que tenía su estancia en términos de Xaltocan; que la hubo y compró de Juan Bautista Figueroa habría tres años en el lugar en que estaba; que no hizo allí los corrales y casa, sino a ochocientos pasos de donde le señaló, hacia el norte; que el lugar donde actualmente estaba lo había poblado como de un año a aquella parte, y que habría un año había tomado posesión del sitio. 1567.

González states he purchased the estancia from Juan Figueroa three years prior, and that he had taken possession and populated the property.

397. Examinados despues dos testigos, deponen, en substancia, la mutación de la casa y corrales hecha por González en el tiempo y distancias arriba dichas. 1567.

398. En vista de todo, en 20 de mayo de 569, mandó el Juez que las partes alegasen y probasen lo que es conveniente, para lo que recibía a prueba la causa. Se hizo saber a las partes. 1569.

401. Sigue una razón simple del Alcalde Mayor que parece consulta extrajudicial. En ella dice haberse entregado el proceso y no haberse respondido cosa alguna; que las partes no habían aparecido a dar las pruebas; que quería Alonso González se confirmase y diese por buena la medida de su estancia y se le amparase en ella, y así le dijesen lo que como juez debía proveer. 1569.

En vista de los autos, proveyó el Juez uno a los 25 de febrero de 570, en que mandó que ante todas cosas González derribase las casas y corrales que de su autoridad puso donde las tenía en la actualidad, poniendolas donde al principio y cuando entró en la estancia estaban, dentro de seis días, con apercibimiento de hacerse por la Justicia a su costa. De este auto pidió traslado González. 1570.

Es el interrogatorio de parte de González a cuyo tenor, desde el 21 de diciembre de 570, se examinaron seis testigos de toda excepción, los que en substancia absolvieron las dos primeras preguntas reducidas a probar que la merced hecha a Juan Gamarra era en los términos de Xaltocan, yendo por el camino que de él va a Tecamac, sobre la mano derecha junto a una calzadilla, casi en medio de los dos términos, como a dos tiros de ballesta a mano derecha del dicho camino, y que la casa hecha por Gonzélez estaba dentro de estos términos. 1571.

Dióla González con tres testigos, de los que el primero se halló presente a la posesión de Gamarra, causante de González, diciendo haber sido viniendo de Xaltocan a Tecamac, hasta llegar a una vereda alta, quedando la estancia a mano izquierda; que se llegó a una calzadilla, en un llano arriba, de donde bajaron a un ojo de agua; que Gamarra puso en el sitio una cruz, a cuyo lugar se le mandó guiar, y se puso por Jaramillo una señal. El segundo fue el mismo que dió la posesión a Gamarra, a la que se remite, reducida a las mismas señas en las que les concuerda el tercero. 1571.

González, with three witnesses—one of whom was present at the toma de posesión by Gamarra—describes boundaries in some detail, and Jaramillo asks about places Gamarra had marked with a cross.

Alegando, pues, de su justicia, la parte de Juan Valladolid dijo no haber lugar lo pedido de contrario (en orden a que fuese hechado de la estancia, en la parte que decía González habérsele introducido), porque la estancia de Valladolid estaba distante de la de González, y que aun cuando no lo estuviera, eran constantes las condiciones con que a Gamarra se hizo la merced, y no las había cumplido; que su parte era quien primero se había de medir; que la contraria vió y toleró y aun hizo concierto con Bueno sobre el asiento que éste hizo de la estancia; que la medida de Jaramillo fué con la duda del lugar en que había de comenzar. Further, Valladolid states that the survey by Jaramillo was executed while uncertain of the precise location at which to start.

Dice que la estancia litigiosa había sido poblada en tres partes; y cuando fue suya, se arrimó a un camino que va de Tecamac a Xaltocan, conforme a la merced, y llevó para que le enseñasen el lugar donde se asentó la primera vez a Juan Ramírez Zamora y a un hijo suyo, y allí puso una cruz y le dijeron que la savana del término era más de una legua; que habían asertado con el término del sitio por un ojo de agua que había; que ignora la distancia de pasos de una a otra estancia; que habiéndose tratado pleito entre el declarante y Juan Badillo, haba ido un receptor a medir y habían quedado de acuerdo de que cada uno se quedase donde estaba, pero no se hizo escrito de ello. Luego siguen declaraciones de otros dos testigos que también depusieron, con poca diferencia, lo mismo que lo demás. 1579.

Deposition by Alonso González which states how the estancia in question was populated according to the conditions of the land grant, how he had Juan Ramírez and his son as witnesses when he planted a cross, and other details. The deposition states how González and Badillo became litigants, a delegate was commissioned for the survey, and that both parties agreed to remain where they were, but that there was no written agreement. Also includes desposition of two witnesses who generally agree with these statements.

relaciona que en el sitio de Badillo había sucedido el Colegio de Tepozotlán, a quien una vez medidos los dos mil pasos del sitio de González, que era ya del Colegio de San Pedro y San Pablo, desde donde terminasen podía verificar el que fué de Valladolid, sin que en él se le introdujese el Colegio de México. Such was the state of the litigation until May 11, 1616. Two arbitrators accepted Jaramillo's survey; and the Audiencia had decreed that Badillo remove his houses and corrals 320 pasos away from a house that González had built on land now belonging to the Colegio de San Pedro y San Pablo; that said Colegio could not lay claims beyond the 2,000 pasos allotted to it and could not intrude in lands belonging to the Colegio de Tepozotlán. Several sequences of documents related to the water mills and mining properties transfered from Pedro de Soto Cabezón to Bernardino de Saavedra and subsequently to Lorenzo Yáñez, Pedro de Iriarte, and Francisco de Yáñez. Many papers concern confusion that arose during the settlement of estates and in public auctions, partly because of parties with similar names, and further because of uncertainty as to what properties were involved in transactions and litigations.

The documents in this sequence bear the scribal label "Tomo 4," however, they are affixed in the same binding as Tomo 3. The sequence bears a close relationship to the Tomo 2 series (no. 648-661), with some cuadernos being updated compendia concerning properties associated with Haciendas Altica and San Javier. Some are near duplicates.
